Please read these Terms and Conditions carefully before using the services offered by  WAHDAH Technologies Sdn Bhd (“WAHDAH“) or (“We”, “Us”, or “Our”), a company incorporated under the laws of Malaysia. These terms set forth the legally binding terms and conditions for your use of Our Services as contained in http://www.wahdah.my (“Website“) (collectively with the site, referred to as “Services“).

 

      1. DRIVER'S AGE AND LICENCE REQUIREMENTS

The Renter and additional drivers must be between 23 to 65 years old for normal car category vehicles and 25 to 65 years old for luxury car category vehicles and in possession of a full and valid national or International Driving Licence. Other nationals who hold a valid driving license in English can drive in Malaysia for a maximum of 3 months (subject to country). Probational license holders will not be accepted.

 

       2. RENTAL PERIOD

The Renter shall rent the vehicle for the rental period stated in the booking confirmation. WAHDAH may agree to extend this rental period at its own discretion. If the renter fails to return the vehicle at the end of the period. WAHDAH shall either charge the rental at the contracted rate for the period of time renter has possession of the vehicle or WAHDAH resumes possession of the which case the renter shall be liable for all costs and expenses incurred by WAHDAH in resuming possession of the vehicle. The Renter shall return the vehicle, together with all tyres, tools, accessories, and equipment to the WAHDAH station specified or any location on the enclosed rental agreements (location & date).

       2.1 WAHDAH Responsibilities

  • WAHDAH shall maintain the vehicle to the manufacturer's recommended standard. WAHDAH undertakes to ensure that the vehicle is in a roadworthy condition and suitable at the beginning of the rental period.
  • To ensure the car came with valid insurance coverage
  • Provide replacement vehicle in case of accident or breakdown for with similar class that rented from WAHDAH.

        2.2 Renter's Responsibilities

  • The Renter shall ensure the vehicle and keys are kept in good condition at all times during the period of the rental.
  • The Renter shall ensure the vehicle is kept locked when the vehicle is not in use, and the Renter will incur a charge (which WAHDAH will set from time to time) for lost keys.
  • The Renter shall utilize any security device fitted to or supplied with the vehicle. The Renter must ensure that the correct fuel is used for the vehicle.
  • The Renter shall be fully responsible for any damage to the exterior part of the vehicle (front, rear, upper, lower sides and undercarriage) caused by hitting any object. This applies irrespective of whether or not the Renter has opted for the super liability reduction option and liability reduction option in accordance with clause.
  • The renter shall not sell, rent, remove, replace or dispose of the vehicle or any of its parts thereof. The renter shall not grant any person (s) any legal right over the vehicle.
  • The Renter shall not carry out any repair or service work on the vehicle without obtaining the written permission of WAHDAH
  • The Renter must notify WAHDAH immediately as soon as the Renter is aware of a defect or damage in the vehicle and the Renter is liable for all damage and loss (including theft) caused to the vehicle during the period of the rental.
  • Upon the end of the rental period, the Renter shall return the vehicle to the agreed return location, during the operating hours displayed at the rental location and WAHDAH's team shall examine the vehicle to ascertain that the vehicle is in good condition. Where WAHDAH has agreed that the Renter may return the vehicle outside operating hours, or where the Renter has requested collection of the vehicle. The Renter's liability of damage, theft, parking violations and charges shall extend to midday on the first working day following the collection time (working day is defined according to station operating hours or the time of re-inspection of the vehicle by a member of WAHDAH's team.
  • Damage to the vehicle includes damage and/or loss of glass, tyre rims, vehicle lights, tyre and interior accessories.
  • The renter shall pay for repairs is the vehicle requires more than WAHDAH standard cleaning, or if the vehicle has been damaged on the interior or exterior (whether or not it is the Renter's fault).
  • The renter shall ensure, on the return of the vehicle that the renter has not left any personal belongings in the vehicle and WAHDAH shall not be responsible for any of the Renter's personal belongings left in the vehicle
  • The renter should ready or prepare necessary card, especially Touch N Go card by their own. Wahdah will not responsible or entertain any issue of claim/refund regarding the card.

       

        3. RATES

Rates are for a minimum of 24 hours of rental. Additional hours will be calculated upon booking at one-fifth of the daily rate per hour up to a maximum of 5 hours upon booking. Rates include unlimited mileage, maintenance, passenger liability protection and insurance cover of third party property damage and third party bodily injuries. Wahdah did not practice any prorate. So there is no refund due to early return. Rates are in Ringgit Malaysia. Rates are subject to change without prior notice.
 

 

       4. TERM OF PAYMENT     

       4.1 Mode of Payment

WAHDAH accepts credit and debit cards Visa and MasterCard upon online booking. Third party credit cards are not accepted. The credit card presented must be in the name of the authorized renter. WAHDAH reserves the right to refuse its car rental services if this term is not met. Cash transaction is not acceptable.

       4.2 Deposit

In addition to the rent charges, the customer is responsible to pay a deposit. We reserve the right to terminate the rental agreement if the customer fails to make payment at the time specified. The deposit is an equivalent as a guarantee of proper usage of the vehicle for the entire duration of the contract, a sum which will be reimbursed if no damage is notified. Deposit should be paid upon the booking confirmation and will be refunded to the renter wacash account after 15 days the car returned. Renter have to request for withdrawal by themself.

 

        5. CANCELLATION AND REFUND POLICY

        5.1 Full Refund 

Reservations canceled by email or call to our hotline within one (1) week / seven (7) days before the start of the rental. No cancellation fees will be charged.

        5.2 Partial Refund 

  • Cancellations made within 3 days / 72 hours before the start of the rental will be charged 50% from the rental fee.
  • Downgrade vehicle within 3 days / 72 hours before the start of the rental will be charged 50% from the rental fee of the original booking.

       5.3 No Refund

  • Cancellations made less than 24 hours before the start of the rental.
  • Cancellations made to downgrade vehicle less than 24 hours before the start of the rental.
  • Failure to provide actual driver as registered on the form to collect the car at the specified date & time.
  • Vehicle cannot be picked up or failure to collect the car at the specified date & time.

       5.4 Claim &  Refund Process

  • Contact us within the time that was stated in the cancellation policy to document the issue and place a hold on the booking payment. Include invoice or other evidence of the issue as part of your claim.
  • Be responsive to our requests for additional information and cooperation.
  • Have used reasonable efforts to remedy the circumstances of the Rental Issue with the driver/person-in-charge prior to making a claim, including messaging your contact on WAHDAH to notify them of the issue.
  • We'll notify the transaction of refund through email. The amount will be credited to customer's wacash account after the car return. Renter can request for withdrawal by their own, 15 days after the car return.

       

       6. EXTENSION OF RENTAL AND PENALTY

  • Should the renter wish to extend the rental, appoint any additional drivers, amend pick up or return location, it is compulsory to advise WAHDAH immediately to facilitate the extension of insurance coverage.
  • Fail to notify and payment will effect with a penalty. Follow as charges and type of penalties :

       7. OTHER CHARGES 

The renter shall pay the following charges :

  • The rental charges and other optional charges at the rates shown on the rental agreement.
  • Any charges for loss or damage resulting from non-compliance
  • A refueling charge due to insufficient fuel tank upon return (check-in)
  • On demand, all fines and court cost for parking, traffic or other offenses (including any costs which arise if the vehicle is clamped or towed). The Renter must pay the appropriate authority any fines and cost failing which, the Renter shall be responsible to pay WAHDAH an administration fee of Ringgit Malaysia Twenty (MYR20.00) when WAHDAH deals with these matters.
  • On demand, the full cost of repairing or replacing the vehicle if it is damaged or stolen (even if it is not the Renter's fault). The Renter may not have to pay the whole of the cost of repairing or replacing the vehicle if the Renter has accepted WAHDAH Liability Reduction Option.
  • On demand a loss of income charges. WAHDAH will charge the Renter at the contracted rate if WAHDAH is unable to rent out the vehicle on the grounds it needs to be repaired or is a total loss and WAHDAH is waiting to receive full payment of the vehicle's value. WAHDAH shall not charge the Renter for more than 30 days loss of income. The renter shall also be liable to a charge for any diminution in value of the vehicle on resale as a result of damage to the vehicle during the rental period.
  • On damage any charges made by the authorities as a result of a seizure.
  • Any rates for delivering and collecting the vehicle which WAHDAH will set from time to time.
  • On demand WAHDAH costs including legal fees where permitted by law, incurred in collecting payments due from the Renter hereunder.
  • Value added tax and all other taxes and levies on any of the charges listed above, as appropriate.

 

       8. RISK AND PROTECTION

The renter shall be held responsible for all MAJOR DAMAGES caused to the vehicle, including theft regardless of fault. In the event of an accident of theft, PROVIDED the renter has agreed to accept the LRO and make a police report within 24 hours from the time of the accident or theft, WAHDAH shall be entitled to charge the renter an excess fee which is in accordance with the following table ("Excess Fee"). Upon the renter's acceptance and subject to the terms and conditions stipulated in the Rental Agreement, the renter's liability is limited to the Excess Fee.

         8.2 ZURICH Travel Insurance


The renter may also purchase Zurich Travel Insurance (Z -Travel Domestic/Inbound Policy), provided by Zurich General Insurance Company Berhad.

         AGE LIMIT

The insurance shall apply to any insured person from age 30 days years old up to 80 years old, except the insured person is aged 70 years and above upon the commencement of the insured journey, he/she will only be entitled to 50% of the BENEFIT A - Accidental Death and Permanent Disablement.

         COVERAGE

It is hereby declared and agreed that the Table of Benefits as stated in the Group Personal Accident Insurance Policy Wording is amended to read as follows and not otherwise stated:-

         9. CONDITION OF USAGE VEHICLE 

  • The vehicle shall not be operated by any person(s) who has given to WAHDAH a fictitious name or false age or address.
  • The vehicle shall only be driven by person(s) named overleaf, or by anyone WAHDAH authorizes in writing. Anyone driving the vehicle must have held a valid full current driving license for at least one year.
  • Probationary license holders are strictly not permitted to drive WAHDAH vehicle.
  • The renters or any authorized driver shall not use the vehicle for hire to rewards, any illegal purpose, vehicle off-road, racing, pacemaking, test drive, testing the vehicle's reliability and speed, to propel or tow any vehicle or trailer or to teach someone to drive, under the influence of alcohol, drugs or any other illegal substances as determined by the authorities.
  • Carry a number of passengers and/or baggage which could cause the vehicle to be overloaded or to transport goods in violation of customs regulations or any illegal manner as determined by the authorities.
  • Entry to Thailand is strictly prohibited.
  • Any cause to unpleasant odor (e.g durian, salted fish, perfume, a material used in the practice of religion, etc.)

 

      10. CROSS BORDER TO SINGAPORE

The renter has the flexibility to drive to Singapore with the following requirement

  • Declare destination upon booking
  • Purchase additional insurance upon booking 

WAHDAH will not entertain any refund request Autopass card balance.

 

       11. RESTRICTED ENTRY 

WAHDAH vehicles cannot be driven into Thailand, Brunei, and Indonesia. Subsequently, vehicles are prohibited from being loaded onto other modes of transportation via sea, river, and air for usage from the mainland to Langkawi, Tioman, Redang, Pangkor island, etc. Cross border to Singapore is subject to approval with certain conditions and additional insurance.

 

       12. RENT-IT-HERE, LEAVE-IT-THERE

Minimum rental (2 days) will be applied and repositioning fee will be levied based on kilometers for one-way rentals. Details on the charges and procedures will be made available at the time of online inquiry. This service is only applicable between WAHDAH locations and coverages.

 

       13. TERMINATION OF AGREEMENT 

Agreement of rental will be terminated upon the occurrence of one of the following events:-

  • If the Renter shall fail to cause any punctual payment of rental or any amount due hereunder.
  • If the Renter shall fail to observe or perform any condition, term or covenant herein;
  • If the Renter suffers any distress or execution to be levied on the Renter's goods or being a company make arrangement or arrangements with its creditors or enter into liquidation whether compulsory or voluntary or have a receiver appointed or winding-up order or proceedings is levied threatened upon the Renter or any judgment against the Renter shall remain unsatisfied for more than thirty (30) days

 

        14. GOVERNING LAW

This agreement is governed by the laws of Malaysia. Any dispute may be submitted to the jurisdiction of the Malaysia Courts. If any provision of this Agreement is or becomes invalid or unenforceable the remaining provisions shall not be affected.

  • The Wahdah Voucher cannot be used for Live Car or last minute booking (24 hours prior to pick up time).
  • The Wahdah Voucher is only valid for bookings with duration less than 10 days. Not applicable for monthly rental and leasing.
  • The customer is allowed to book up to two (2) bookings on the same day. No multiple bookings for travel on the peak seasons.
  • The customer can have up to 3 reschedules, or no show, after which the Wahdah Voucher is forfeited and Wahdah will refund customer deposits only.
  • Wahdah Voucher is not available to purchase by travel agencies, or any parties other than individual WaClub's member. In the event any travel agency or party other than individual WaClub's members purchase the voucher and subsequently made a booking using the voucher, Wahdah shall have the right to cancel/forfeit the voucher and the bookings, without any liability on the part of Wahdah to such agency, third party or any customers.
  • The Wahdah Voucher cannot be sold, bartered, assigned or transferred to another person. Any attempt to transfer the Wahdah Voucher or book using the Wahdah Voucher for someone other than the owner of the Wahdah Voucher will result in immediate forfeiture of the voucher. 
  • The Wahdah Voucher is only available to be purchased by WaClub Members at www.wahdah.my and www.wahdah.sg.
  • Redemption of WaPoints is not allowed for the purchase of the Wahdah Voucher.
  • The Wahdah Voucher is non-refundable or exchanged for cash or any other products in kind.

  • Unlimited validity.

For the purposes of this document we have given the following words or expressions particular meaning:


We or we/ Us or us / Ours or ours means WAHDAH


You or you / Yours or yours means any named driver


The Renter means the registered driver who drive the vehicle


Vehicle means the vehicle booked by online booking at www.wahdah.my and you will be renting from us or you will be driving with our authorization.


Abnormal use: means that your use of the Vehicle whilst you are in charge of it doesn’t comply with the Road Traffic laws that prevail and/or does not meet with the requirements of the Local Rental terms and conditions and/or does not meet with the standards of driving that would be expected of a reasonable and prudent driver


Accident Report (“declaration d’accident”) means a full and complete signed statement (including any other document(s)) which records all of the facts of an accident or incident as they occurred (for example, how the event occurred, the nature of the damage to the Vehicle, the location where the incident took place, the dates and circumstances and any potential witness details)


Baggages means the driver its passengers travel bags and suitcases and the personal effects and belongings they contain. Personal effects include valuables worth Five Hundred Ringgit (MYR500) or more as well as jewellery (natural pearls and cultured pearls, precious and semi-precious stones) and furs belonging to the drivers and its passengers Luggage includes laptop computers, electronic diaries, audiovisual equipment, cameras, video recorders and Hi-Fi equipment belonging to the driver or its passengers.


Bodily Injury (or bodily injury) means any physical injury suffered by a person that is caused as the direct result of an accident; it is not something that is intentionally self-inflicted and it does not result from sickness or disease


Book value means the value that a Vehicle is recorded to be worth to us on our books at the time of the incident.


Collision means the impact of the Vehicle with another fixed or moving body or object


Excess amount is a specified sum of money that, provided you have complied with the Local Rental terms and conditions and have not committed a breach of any applicable laws, is the maximum amount we will charge you for the cost of any damage caused to the Vehicle as a result of a collision during the rental period or its attempted theft; or the loss of a Vehicle if it is written off because it is irreparable or if it is stolen and we do not get it back. The Excess amount is a non-waivable sum that is governed by the conditions of the protection product you have purchased.


Local Rental terms and conditions means the document you acknowledge that you have read and approved when you sign your rental agreement and which sets out the rights and obligations that will apply to both you and us throughout the rental period


Loss of Use describes the circumstances where a Vehicle is unavailable for us to rent to another customer because, as a result of a collision during the rental period it was damaged and we need to take it off the road to have it repaired


Passenger means any person other than the driver that is being transported or is travelling in or on the Vehicle on a gratuitous basis. A Passenger would be viewed as a Third Party under the mandatory Third Party Liability insurance regimes


Protection (or protection) in this document applies to the means by which your financial liability for any damage to or loss of a Vehicle is limited to the Excess amount.


Third Party means any party to an incident - other than the driver of the Vehicle. For the avoidance of doubt, a Passenger is deemed to be a Third Party


Third Party Liability insurance means insurance that provides the driver of a Vehicle with protection against liability for another party’s claims for damage to his/her property or for bodily injury or death arising out of an incident arising whilst you are using the Vehicle. Third Party Cover is a mandatory legal requirement and it is therefore an integral part of our rental service. The cost of it is included in the rental charge.


Vehicle means the vehicle booked by online booking at www.wahdah.my and you will be renting from us or you will be driving with our authorization.


 

Minimum Duration: The minimum booking duration for which the prices will be charged is 5 hours.


Cancellation: 

  • Cancellations made within 3 days / 72 hours before the start of the rental will be charged 50% from the rental fee.
  • Cancellations made less than 24 hours before the start of the rental will be no refund.
  • No show or vehicle cannot be picked up or failure to collect the car at the specified date & time and it will be no refund

Reschedule before start: Modifications made more than 12hrs before booking start: MYR100


Shortening post start: No charges or refunds applicable


Late Return: Penalty for the late return would be charged at MYR25 - MYR90 per hour in addition to the hourly fee for use of the vehicle


Free Kilometres: The free kilometres for Peninsular Malaysia. Fee will be applied for travelling at Sabah and Sarawak, list of fee here.


 

 

List of penalties that can be levied if members violate certain WAHDAH community rules. 


Returning the vehicle to the wrong location: Fee of MYR50 - MYR100 will be applied depending on KM from the actual location.


Traffic and Parking violations: Full payment with additional MYR20 processing fee


Overspeeding >= 110 km/hr: Expulsion from WAHDAH if overspeeding occurs in three bookings


Smoking: MYR200 - MYR300 + applicable damage costs related to interiors


Wrong Fuelling: The user will be liable for the full cost of damage to the vehicle + miscellaneous expenses arising out of the damages.


Key not returned or loss: MYR1000 + replacement cost
